General Terms & Conditions

1. Introduction

1.1. Website Ownership

These Terms & Conditions govern the use of https://www.yachtmauritius.com (“the Website”), operated by Yacht Management Ltd (YML), registered in Mauritius (BRN: C09047473 | Certificate No. 47473) with its head office at Shop 19, L’Estuaire, La Balise Marina, Black River.

1.2. Purpose

These terms outline the conditions under which YML provides services through the Website, supplementing the “Legal Notice and Terms of Use”. YML reserves the right to modify its content or services at any time without prior notice.

1.3. Updates

Updates to these Terms will take effect once published on the Website. Users should review them before making a booking. The version in effect at the time of booking will apply.

2. Use of Services

2.1. Booking Process

To make a reservation via the Website, users must at least be 18 years old. Registration is not required in advance; relevant information is collected during the booking process.

2.2. Booking steps:

  • Choose your service, date, and options
  • Click “Book Now”
  • Enter personal and payment information
  • Review the booking summary
  • Confirm by clicking “Proceed to Check-Out”
  • Make the payment to confirm the booking

2.3. Confirmation

Payment confirmation signifies acceptance of these Terms. A confirmation email will be sent within 24 hours. In case of errors, you may request corrections or cancel the booking. Invoices are available upon request.

2.4. Right to Deny Service

YML reserves the right, at their sole discretion and without indemnity, to deny service to users who including but not limited to, misuse the system or act in bad faith.

2.5. Service Information & Pricing

All services include detailed descriptions and final prices (EUR or MUR) and are inclusive of taxes. Availability is not guaranteed and may change without notice. Should your selected option become unavailable, alternative dates or services will be proposed.

2.6. Payment

All payments must be completed through our secure payment gateway (managed by MIPS). While YML is not responsible for the third-party (MIPS) payment processing issues, we will provide reasonable assistance in resolving issues when and if possible.

4. Personal Data Protection

4.1. Data Collection and Processing

YML collects and processes personal data to:

  1. Manage bookings
  2. Maintain customer relationships
  3. Send promotional offers (if consented)

4.2. Data Rights

You may exercise your rights to access, modify, delete, restrict, or object to processing. Requests should be submitted directly to us. Additional data protection terms may apply to specific services.

5. Separate Provisions

The provisions of this Agreement are severable and if any provision is held to be invalid, illegal or unenforceable, in whole or in part under the laws of any jurisdiction, the validity, legality and enforceability of the remaining provisions shall in no way be affected or impaired thereby and the remaining provisions or portions hereof shall, nevertheless, be binding on and enforceable by and between the parties hereto provided that the continued enforcement of such remaining provisions does not materially prejudice either party in their respective rights and obligations contained in any valid provisions of this Agreement.

6. Governing Law

6.1. Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the Republic of Mauritius.

6.2. Dispute Resolution

The Parties will attempt to resolve amicably and in good faith any dispute or any claim arising out of or in connection with this Agreement. The matter in dispute shall be first referred to in writing by the plaintiff Party to the other Party.

6.3. Legal Proceedings

In the event that no amicable agreement can be reached in a one (1) month period after the notice of such dispute has been given, it will be submitted to the exclusive jurisdiction of the Courts of the Republic of Mauritius.

7. Updates

YML may revise these Terms periodically. The latest version accessible for review will be the one in force.

Charter Special Terms & Conditions

1. Contract Formation

A valid booking is established once:

  1. Both parties have accepted both the General Terms and Conditions and the Special Terms & Conditions; and
  2. YML has received the payment.

Payment of the service signifies the customer’s full understanding and agreement with these terms.

2. Vessels in Operation

Fontaine Pajot Mahe 36 — Sailing Catamaran

  • Max Capacity: 13 passengers
  • Features: 3 double cabins, private toilet & shower, kitchen, sound system, fridge & freezer, gas BBQ, kitchen.

Beneteau Gran Turismo 40 — Motor Yacht

  • Max Capacity: 8 passengers
  • Features: 2 double cabins, private toilet & shower, air-conditioning, generator, electric BBQ, microwave/oven, teak flooring, fridges, sound system, submersible swim platform, underwater light.

3. Included Equipment

All cruises will include the following equipment for the guests onboard:

  • Snorkeling gear (masks & fins)
  • Towels
  • Tableware (cutleries, napkins and all essential equipment for eating)
  • Bedding & linen (overnight cruises only)

Note: Wi-Fi and entertainment systems are not available onboard.

4. Catering & Drinks

Catering options vary by cruise type but are the same on both boats, a detailed menu is available and will be sent to the client on his/her request only.

  • Full-day cruise (10AM to 4PM): 3-course lunch
  • Half-day (8AM to 11AM): Breakfast
  • Sunset (4PM to 6PM): Snacks
  • Overnight (multiple days): All meals included (catamaran only)

Drinks: Offered on all cruises on both boats. Alcoholic beverages available during full-day, sunset, and overnight trips but not on half-day trips. Selections include wine (white, red, rosé), beer, soft drinks, juices, tea, and coffee, water, etc.

Dietary Needs:
Please inform YML of any allergies or dietary requirements at least 7 days before embarkation. We will accommodate requests when possible; additional charges may apply.

5. Taxes

Unless stated otherwise, all prices include VAT and other applicable taxes at the time of the booking.

6. Payment Terms

YML proposes two ways of paying for its services:

  1. If the payment is affected through the website — 100% of the amount due will be claimed
  2. If the payment is affected through other means (e.g. email, whatsapp, office) the client may, subject to YML’s approval, pay a deposit first and the balance on the day of the cruise.
  • Deposit: 20% (non-refundable) upon booking.
  • Balance: 80% due on the day of the cruise.

7. Cancellation Policy

By YML:

YML reserves the right, at its sole discretion, to cancel any booking for reasons including but not limited to:

  • Cyclones or adverse sea/weather conditions
  • Force majeure events
  • Safety concerns

If YML cancels, customers may choose to reschedule or receive a full refund without any further claim for compensation.

Cancellations must be submitted via email: info@yachtmauritius.com
A no-show is defined as failure to arrive at the agreed meeting time and location.

8. Liability

  1. The client hereby waives, releases, and fully discharges YML and their respective officers, directors, employees, agents, affiliates, representatives or anyone acting on YML’s behalf or under its instructions from any liability and against any claims (in whatever form and to the fullest extent permitted by law) arising out of or in any way connected with this agreement and YML’s obligations thereunder.
  2. The client will indemnify and hold YML harmless from any claims, actions, damages, liabilities and expenses in connection with loss of life, personal injury or property damage arising out of or resulting from any event occurring through the services provided or the use by the client of a vessel or any part thereof, or occasioned in whole or in part by any act or omission of the client, except where such claims, actions, damages, liabilities and expenses arise from the negligence, “fault”, willful act or omission of YML, its employees or agents. In the event that YML, through no fault of its own, becomes a party to a dispute brought by or against the client or against or by a third party, then the client will protect and release YML from any liability against such proceedings, and shall pay, all reasonable costs, expenses and legal fees incurred or paid by YML in connection therewith.
  3. YML shall not be liable to the client or any third party for any loss, damage, disruption of services or usage of YML services for any reason, including but not limited to acts of God, pandemic, fires, explosions, civil commotions, strikes, lockouts and lockdowns, emergencies, local or regional disasters of any kind including meteorological phenomenons, third party actions, regardless of the nature or duration thereof.
  4. All minors will be under the responsibility of their parent/carer at all times. The provisions of this clause (Liability) will be binding and enforceable with regard to minors.
